Terms of service
All quotations and bookings made with Golilo (Pty) Ltd, Registration Number: 2019/434370/07 (“Golilo” / “we” / “us” / “our”) are subject to the following terms and conditions, which will form the basis of the contract between the Guest(s) (“you” / “your” / “the Guest(s)”) and us (collectively referred to as the “parties”). For clarity, Guest(s) include the primary contact person that Golilo engages with as well as all other people travelling as part of that group.
Please read them carefully as they form the basis of our obligations to you, and you to us.
By paying the required deposit you are confirming that you have read these terms and all other information that has been supplied to you and that you understand and accept them.
Accuracy of Information
All information that we have provided including that contained on our website and in our brochure(s) is given in good faith and is to the best of our knowledge a fair representation of our destinations and the facilities offered. We pride ourselves on the accuracy of our information but cannot accept liability or responsibility for any errors caused by circumstances out of our control as information may change rapidly.
Travel documents
It is the Guest’s responsibility to ensure that all travel documents (passports and visas), health, vaccination status, and COVID-19 PCR test requirements are in order prior to travel to ensure no delays or cancellation. If you are unsure of any travel requirements, please check with us.
The Guest’s passport must have sufficient blank visa pages available in accordance with the regulations of various countries.
The Guest’s passport must be valid for the prescribed period contained in the applicable regulations of the countries you will be entering, transiting and/or visiting.
If you are travelling with minor children, please be aware that at some border crossings you may need unabridged birth certificates or, if travelling alone, you may need to provide a letter of consent from the absent parent(s) that the children are allowed to travel with you.
Golilo will not be held responsible for any missed travel connections occasioned by incorrect or insufficient travel documentation. Golilo will not be held responsible for any air tickets issued in the incorrect name if clear copies of passport / ID have not been received in a timely manner.
Flight Rules
All airlines require the full names of passengers as stated in their passports.
After air tickets have been issued, any changes or cancellations will be subject to the relevant airline’s terms and conditions applicable to that fare type. Should a refund be granted by the relevant airline, it may be subject to a delay. We will only be obliged to refund any amounts once they have been received from the relevant airline.
It is the Guest's responsibility to check and correct any errors in respect of your flight reservations which appear on the quotation or booking form, and we accept no liability for incorrect details provided by you.
Airfares are only guaranteed once final payment has been received and the air ticket has been issued.
If any airline levies additional or increased airport taxes and fuel charges at any stage prior to your flight, you agree that such an increase will be for your account and shall be payable to us or to the airline if instructed to do so.
It is the guest’s responsibility to reconfirm all onward and return flights with the relevant airline at least 72 hours prior to your flight.
We cannot guarantee any airline seating or meal requests, however we will endeavour to assist you with this within reason.
Air tickets which are unused for more than 1 year from the date of their issue are considered to be expired and must be submitted to the relevant airline for their authority to refund. We will make every effort to assist you in obtaining this refund, but cannot provide you with any guarantees in this regard.
Baggage Rules
It is your responsibility to ensure that you meet the baggage regulations of the airlines and charter companies that you will be using. If you do not adhere to these, the transfer of your baggage may be delayed and/or transferred at extra cost to you.
In particular, light aircraft flights have extraordinary baggage regulations which include, but are not limited to, weight, structure and shape.
Your baggage and personal belongings remain your responsibility at all times. We will not accept any liability for your misplaced baggage or any loss or damage to your baggage or personal effects.
Travel Insurance
Golilo requires that you purchase fully comprehensive travel insurance at the time of making your reservation. We recommend that your insurance policy covers the following: repatriation, emergency evacuation and search and rescue, cancellation or curtailment, medical expenses, loss of luggage, death, personal injury, illness, and loss or theft of personal property including your luggage.
You acknowledge that without such travel insurance, you will be responsible for all costs arising from any cancellation, re-routing, rescheduling of your trip, any emergency (medical or other), any loss of luggage or personal effects, or other liabilities that may arise during your travels.
You specifically agree that, in the event of you failing to purchase adequate insurance cover, you will not hold Golilo responsible for any harm or loss that you may suffer.
Deposit and Securing your Booking
In order to confirm your booking, you will need to make a deposit as stated in your invoice. This includes:
for air travel, 100% of the cost must be paid up front, as air tickets need to be issued immediately; and
for accommodation bookings, up to 50% of the cost of the accommodation booking must be paid up front; and
additional deposits may be required for peak season travel and specialist products.
All of the deposits paid in terms of the above are non-refundable, but Golilo reserves the right to consider such matters on a case by case basis.
The outstanding balance is due between 30 and 60 days prior to travel, depending on the property or service booked. If a booking is made less than 60 days prior to travel, the full cost of the booking (“total booking price”) must be paid up front.
Failure to make the required payment(s) means that we will be unable to confirm the booking for you and you will forfeit the relevant deposit(s) paid.
Payment is required by Electronic Funds Transfer (bank transfer or EFT). Credit card payments can be accepted, but they do attract additional charges of up to 5%, depending on the provider. This is not revenue for Golilo but rather the charge made by the processing company.
All quotations and confirmations generated by us are based upon external supplier costs such as air fares, airport taxes, fuel surcharges, accommodation, car hire, park fees and gate fees which are outside of our control. These supplier costs are therefore subject to change until final payment has been received or, in the instance of air travel, until air tickets have been issued, and any additional costs will be for your account.
Changes to Bookings
Please note that you will be responsible for paying any additional charges arising from booking changes, whether voluntary or involuntary, and this includes:
all costs and fees resulting from changes requested by you; and
all costs and fees resulting from necessary changes caused by airline schedule changes, airport strikes or any other ‘acts of God’ (for example, but not limited to, war, riots, strikes, civil disruption, terrorist activity, natural or nuclear disaster, weather, epidemics, fire or any other circumstance beyond the control of the parties).
We will make every effort to adhere to the confirmed itinerary, and where involuntary changes are significant, we undertake to:
Try to provide a reasonable alternative subject to the terms and conditions of any third party supplier; and
Where you have declined a reasonable alternative or where this is not available:
i. provide a refund on the service(s), subject to the terms and conditions of the relevant supplier; and/or
ii. assist you to identify alternative services, the costs of which will be for your account.
We will use our best endeavours to accommodate any voluntary changes requested by you, however, in addition to the additional costs arising from this change, including those charged by the relevant supplier(s), we reserve the right to charge cancellation fees and additional administration fees.
Cancellation and Refunds
All cancellations must be made by you in writing and, if sent to us by email, you must obtain an email proof of receipt and retain written acknowledgement of receipt from us.
If you cancel a booking for any reason, whether in part or in full:
more than 60 days prior to departure, you will forfeit the non-refundable deposits already paid by you;
60 days or less prior to departure, you will be liable for 100% of the total booking price;
In occasional circumstances, if we are able to obtain a waiver of cancellation fees or a refund from one or more suppliers, we will refund these amounts, less our service fees, to you.
We will make every effort to confirm the required services with suppliers. In the unlikely event of us being unable to confirm the services after receipt of your deposit, you will be offered alternative available travel service. Should the alternative available travel services not be acceptable we will provide a full refund for those services.
We will make every effort to ensure delivery of the services in the confirmed itinerary. Should a cancellation happen after payment has been made to a supplier, due to the supplier cancelling or an act of god, we will assist as follows:
We will attempt to arrange an alternative service that is acceptable to you;
We will attempt to obtain a refund from the supplier which is subject to that supplier’s own terms and conditions.
No refunds will be given by us if you do not arrive at the designated point and time for a particular service.
Covid-19 related cancellations will be managed on a case-by-case basis, in line with the supplier’s Covid-19 policy.
COVID-19 Disclaimer
The COVID-19 testing rulings are changing on an ongoing basis. We will research the information offered through various websites and channels available to us at the time as a courtesy in an attempt to provide you with useful information.
Governments and airlines can and frequently do change the regulations at any time and therefore, we cannot be held liable or responsible should you not be able to travel due to COVID-19 related implications.
We will endeavour to assist you as our Guest every step of the way and provide as much guidance as possible.
The safety of our Guests is of paramount importance. The Tourism Industry has put together strict health and safety protocols for all hotels and lodges to implement for the safety of their staff and guests.
Complaints and Disputes
Any complaints should be telephonically reported to us at the time of the incident and should be followed up in writing to us, no later than 30 days after the incident has occurred.
Complaints should be forwarded to explore@golilotravel.com.
We will acknowledge your complaint and endeavour to investigate it with the relevant service provider within a 30 day period, after which we will provide you with written feedback.
Although we will make every effort to assist in the resolution of the complaint, we cannot guarantee the satisfactory resolution of complaints for services and products outside of our control and for which we are not responsible.
Any matter, controversy or claim arising out of or relating to our Agreement per Golilo terms and conditions, or the breach thereof, that cannot resolved as above, shall be settled by arbitration in South Africa in accordance with the rules of Arbitration Foundation of South Africa and the award thereof shall be final and binding on both parties and judgement upon the award rendered by the Arbitrator(s) may be entered in any court having jurisdiction thereof. The venue for arbitration will be Johannesburg, South Africa.
Medical information
It is your obligation to ensure that you are medically fit to travel. It is also your responsibility to take the necessary health and medical precautions in preparing for your trip and the correct medical advice should be sought from your local GP or another relevant medical professional before travelling.
It is essential that passengers who are not or may not be fit to participate in these trips and/or who have any medical problems and/or dietary restrictions or allergies consult their doctor and declare them to us before confirmation of the booking. We can then counsel you on whether the trip you have selected is appropriate for you.
Inoculation, Immunisation and Medication
You must ensure that you meet the immunisation, inoculation and medication regulations of the countries to which you are traveling. It is your responsibility to ensure you carry all required proof of your immunisation, inoculation and medication regulations for your trip.

Waiver, Indemnity and Liability
All vouchers, receipts and tickets issued by us to you are subject to the relevant supplier’s terms and conditions.
Participation in any tour or travel package arranged by us and provided by any of our suppliers (including but not limited to transportation to or from any venue) is undertaken at your own risk.
The Guest, his/her heirs, dependants, agents, executors or their assignees hereby irrevocably waive any claims which they may have against Golilo for any form of compensation for damages which they may suffer due to injury and/or loss of any nature whatsoever, which includes accidents caused by the Guest’s own actions, injuries or death while on the trip, in a transportation vehicle or at any place during the tour or illness or death at any time after the tour and including as a result of the negligence of Golilo or its staff.
We act solely in the capacity of an agent for third parties and, as such, we hold ourselves free of responsibility or liability for any delays, loss or damages from any cause whatsoever including loss/delay/damages/ dissatisfaction caused by third party products and services and including as a result of the negligence of Golilo or its staff. We shall be exempt from all liability in respect of any claim whatsoever as aforesaid, the Guest acknowledging that, in the case of a defective product, it is unreasonable to expect us to have discovered the product failure having regard to our role in arranging access to the third party products and services on your behalf.
You acknowledge that travel to the region and country(ies) you have chosen may entail risks that are outside our control and by completing your booking you are confirming that you accept these risks freely and on your own initiative and responsibility. You agree at all times to comply with the instructions given to you by us and by our agents, suppliers, local operators and representatives, and to maintain adequate medical and evacuation insurance during your trip (please refer to the Insurance section above for options). Whilst we will take reasonable steps to avoid and or mitigate the risks concerned, we do not accept liability for any injury or loss that you may suffer due to the actions of third parties or circumstances outside our control.
Third Party Supplier Terms and Conditions
All travel deals, discounted rates and third party goods or services (including airline, transfer, car rental services, tour guide and accommodation services) which are advertised on our website or included in your quotation, are governed by the separate terms and conditions of the relevant supplier of the goods or service, and you agree that it is your responsibility to obtain and review each of these terms and conditions, as you will be bound by them.
Animal Encounters
It is a condition of travelling with us that you will at all times follow the instructions of the guides and staff of our local operators. Should you fail to do so or be overly confident, eager or reckless in approaching an animal, you may be withdrawn from the trip and excluded from taking any further part in it. Should an animal be killed or injured because of a provoked attack, a fine per animal may be charged by a local wildlife officer, which will be your responsibility.
We cannot control wildlife or the weather and do not guarantee that you will see all the wildlife and experience all the weather conditions referenced in our trip descriptions and imagery. It is also possible that access to wildlife may be restricted by national government regulation which we will be required to comply with, and your booking is subject to this.
Local laws and regulations
It is important to adhere to the local laws and regulations of the destination country when travelling with us and these are the laws, regulations and practices that will apply to your trip, not those of your country of residence.
Intellectual Property Rights
All of the content on this site, including text, graphics, logos, icons, designs, colours, layout and trademarks are and remain our intellectual property, protected by law, and you are not permitted to use these for any purpose.

The parties choose the following physical addresses at which any documents in legal proceedings in connection with this agreement may be served (i.e. their domicilia citandi et executandi) and at which any written notice in connection with this agreement may be addressed:

The Guest: At the physical/street address provided in the booking form or the primary e-mail address used for communication with Golilo.
Either of the parties may change this address to another address, by way of a notice to the other party to this agreement, provided that such a notice is received at least 7 days prior to such a change taking effect.
Confidentiality and Data Protection
We undertake to take all reasonable steps to protect your personal information. By making an enquiry with Golilo, confirming your booking or paying the deposit you are agreeing to us processing your personal information for the purpose of arranging your trip which includes your name, identity number, nationality, contact details, address, and personal preferences. It is your responsibility to ensure that you have received the consent of other guests on your booking to share their personal information with Golilo before doing so.. Golilo will treat this personal information as confidential and take all appropriate precautions to maintain the security of this data. We collect only the information that is required in order to book and manage your trip. By providing this information to us, you consent to us sharing this information with third-party service providers when necessary and using any endorsements you provide to us for marketing purposes. We will store this information for a period of 7 years before either deleting it or retaining it in an anonymised form for research purposes, unless we obtain your further consent to continue to store the information.
Golilo processes personal information in terms of the Protection of Personal Information Act 4 of 2013 (POPIA) of South Africa. If you would like to exercise your rights in terms of this Act, you may contact us at explore@golilotrave.com. If you have a complaint in terms of the Act, you may contact the Information Regulator of South Africa at 27 Stiemens St, Braamfontein, Pretoria, 0001, +27 10 023 5200, enquiries@inforegulator.org.za.
General
No amendment, addition or consensual cancellation of this agreement will be binding unless it is recorded in writing.
These terms and conditions together with the quotation and booking form contain all the terms and conditions of the agreement between you and us. Make sure that everything you have agreed to has been recorded in this agreement. If there is any conflict between the provisions of these documents, the provisions of the booking form will prevail.
If any provision of this agreement is found by a court of law to be invalid or void, such provision will be severed from the remaining provisions, without affecting the remainder of the agreement.
Neither party shall lose any of its rights under this agreement if it does not immediately and in every instance insist on them.
This agreement shall be governed by the laws of the Republic of South Africa and shall be enforced by the courts within the Republic of South Africa.
You consent to the jurisdiction of the Magistrates’ Court, notwithstanding the fact that the amount involved may exceed the jurisdiction of the Magistrates’ Court.
If we have to bring legal proceedings against you to enforce payments of amounts owed to us, you shall be responsible to pay all costs incurred by us in collecting the payment.
You shall not be entitled to cede any of your rights or assign any of your obligations under this agreement.
If we are prevented from carrying out all or any of the obligations under this agreement because of an event beyond our control, we shall be relieved of our obligations under the agreement during the period that such event and its consequences continue, but only to the extent so prevented, and we shall not be liable for any delay or failure in the performance of any such obligations or loss or damages which you may suffer due to such delay or failure.
Updated versions of this agreement will be made available on our website as and when our policies and procedures change and when external factors such as legislative updates require. Please make sure that you read these amended terms and conditions carefully and raise any queries that you may have.
